Estate Planning
Our firm strongly encourages our clients to plan for their financial futures and the futures of their families. We work closely with our clients and strive to assist them in analyzing and implementing strategies that will enable them to transfer assets to achieve their objectives and to minimize gift and estate taxes and estate administration expenses. We can provide wills, trusts, powers of attorney, living wills, health care surrogates, pre-need guardians, premarital and post-marital agreements, business and succession plans and any other estate planning documents required to implement a solid estate plan.
Probate Administration and Litigation
Probate Administration is necessary for the transfer of assets pursuant to a person’s Last Will and Testament, or if the person dies without a will, under the intestate distribution law of Florida. Such transfer involves complex considerations.
At Decker & Campbell, PL, our professional staff of attorneys handle every aspect of the Probate process. Such aspects include notifying creditors and satisfying their claims against the decedent, gathering the assets of the estate, preserving such assets, evaluating issues concerning the distribution of assets, implementing strategies to avoid or reduce will contests or related litigation, evaluating strategies to avoid or reduce estate taxes and preparation and filing of all related documents, satisfying tax liabilities from the estate, distributing the assets, preparing the final accounting for the personal representative and achieving release of the personal representative at the close of the probate process. Real Estate Litigation
Real estate litigation refers to a broad range of disputes, ranging from contract disputes, landlord/tenant disputes, commercial lease agreement disputes and sales commission disputes, foreclosure defense, condo deposit refunds, and mortgage disputes, among others. Our firm handles this broad range of disputes with the goal of obtaining a cost effective favorable or acceptable outcome. We examine every aspect of the contract, the dispute, and other relevant facts. Our careful preparation can put the client in a strong position to obtain such an outcome without the need to proceed all the way to trial. However, if that need arises, we will aggressively litigate your real estate dispute in a courtroom.
